These BitMart Terms of Use are entered into between you (hereinafter referred to as “you” or “your”) and BitMart operators (as defined below). By accessing, downloading, using, or clicking on “I agree” to accept any BitMart Services (as defined below) provided BitMart (as defined below), you agree that you have read, understood, and accepted all of the terms and conditions stipulated in these Terms of Use (hereinafter referred to as “these Terms”), as well as our Privacy Policy at www.bitmart.com/privacy-policy. In addition, when using certain features of the Services, you may be subject to specific additional terms and conditions applicable to those features.
Please read the terms carefully as they govern your use of BitMart Services.
THESE TERMS CONTAIN IMPORTANT PROVISIONS INCLUDING AN ARBITRATION PROVISION THAT REQUIRES ALL CLAIMS TO BE RESOLVED BY WAY OF LEGALLY BINDING ARBITRATION.
The terms of the arbitration provision are set forth in Article 10, “Resolving Disputes: Forum, Arbitration, Class Action Waiver,” hereunder.
As with any asset, the values of Digital Currencies (as defined below) may fluctuate significantly, and there is a substantial risk of economic losses when purchasing, selling, holding, or investing in Digital Currencies and their derivatives.
BY MAKING USE OF BITMART SERVICES, YOU ACKNOWLEDGE AND AGREE THAT:
(1) YOU ARE AWARE OF THE RISKS ASSOCIATED WITH TRANSACTIONS OF DIGITAL CURRENCIES AND THEIR DERIVATIVES;
(2) YOU SHALL ASSUME ALL RISKS RELATED TO THE USE OF BITMART SERVICES AND TRANSACTIONS OF DIGITAL CURRENCIES AND THEIR DERIVATIVES; AND
(3) BITMART SHALL NOT BE LIABLE FOR ANY SUCH RISKS OR ADVERSE OUTCOMES.
By accessing, using, or attempting to use BitMart Services in any capacity, you acknowledge that you accept and agree to be bound these Terms. If you do not agree, do not access BitMart or utilize BitMart Services.

11. Designated Stablecoin Conversion means, in respect of each Designated Stablecoin, the automatic conversion of that Designated Stablecoin into BUSD upon deposit or transfer into your Bitmart Account or the conversion of BUSD into that Designated Stablecoin in connection with a withdrawal request.
12. Digital Currencies refer to encrypted or digital tokens or cryptocurrencies with a certain value that are based on blockchain and cryptography technologies and are issued and managed in a decentralized form.
13. Digital Assets refer to Digital Currencies, their derivatives, or other types of digitalized assets with a certain value.
14. Fiat Trading refers to spot transactions in which Digital Currencies are exchanged for fiat currencies or vice versa.
15. KYC refers to the “know-your-customer” process that Bitmart has put in place before entering into a business relationship or conducting transactions with its Users. As part of this process, Bitmart may do anything that it deems necessary in order to identify Users, verify their identity, scrutinize and investigate User transactions, or comply with any applicable law or regulation.
16. Loan/Lending refers to Bitmart’s lending of Digital Currencies to Users at an interest collected in certain ways (in the form of Digital Currencies), including but not limited to the leveraged trading and currency lending services currently offered, and other forms of loan/lending services to be launched Bitmart.
17. Users refer to all individuals, institutions, or organizations that access, download, or use Bitmart or Bitmart Services and who meet the criteria and conditions stipulated Bitmart. If there exist other agreements for such entities as developers, distributors, market makers, and Digital Currency exchanges, such agreements shall be followed.
II. General Provisions
1. About These Terms
a. Contractual Relationship
These Terms constitute a legal agreement and create a binding contract between you and Bitmart Operators.
b. Supplementary Terms
Due to the rapid development of Digital Currencies and Bitmart, these Terms between you and Bitmart Operators do not enumerate or cover all rights and obligations of each party, and do not guarantee full alignment with needs arising from future development. Therefore, THE PRIVACY POLICY (()), BITMART PLATFORM RULES, AND ALL OTHER AGREEMENTS ENTERED INTO SEPARATELY BETWEEN YOU AND BITMART ARE DEEMED SUPPLEMENTARY TERMS THAT ARE AN INTEGRAL PART OF THESE TERMS AND SHALL HAVE THE SAME LEGAL EFFECT. YOUR USE OF BITMART SERVICES IS DEEMED YOUR ACCEPTANCE OF THE ABOVE SUPPLEMENTARY TERMS.
c. Changes to These Terms
Bitmart reserves the right to change or modify these Terms at its discretion at any time. Bitmart will notify users of such changes updating the Terms on its website (URL to be inserted) and modifying the [Last revised] date displayed on this page. ANY AND ALL MODIFICATIONS OR CHANGES TO THESE TERMS WILL BECOME EFFECTIVE UPON PUBLICATION ON THE WEBSITE OR RELEASE TO USERS. THEREFORE, YOUR CONTINUED USE OF BITMART SERVICES IS DEEMED YOUR ACCEPTANCE OF THE MODIFIED AGREEMENT AND RULES. IF YOU DO NOT AGREE TO ANY CHANGES TO THESE TERMS, YOU MUST STOP USING BITMART SERVICES IMMEDIATELY. YOU ARE RECOMMENDED TO FREQUENTLY REVIEW THESE TERMS TO ENSURE YOUR UNDERSTANDING OF THE TERMS AND CONDITIONS THAT APPLY TO YOUR ACCESS TO AND USE OF BITMART SERVICES.
d. Prohibition of Use
BY ACCESSING AND USING BITMART SERVICES, YOU REPRESENT AND WARRANT THAT YOU HAVE NOT BEEN INCLUDED IN ANY TRADE EMBARGOES OR ECONOMIC SANCTIONS LIST (SUCH AS THE UNITED NATIONS SECURITY COUNCIL SANCTIONS LIST), THE LIST OF SPECIALLY DESIGNATED NATIONALS MAINTAINED BY OFAC (THE OFFICE OF FOREIGN ASSETS CONTROL OF THE U.S. DEPARTMENT OF THE TREASURY), OR THE DENIED PERSONS OR ENTITY LIST OF THE U.S. DEPARTMENT OF COMMERCE. BITMART RESERVES THE RIGHT TO CHOOSE MARKETS AND JURISDICTIONS TO CONDUCT BUSINESS, AND MAY RESTRICT OR REFUSE, IN ITS DISCRETION, THE PROVISION OF BITMART SERVICES IN CERTAIN COUNTRIES OR REGIONS.
2. About Bitmart
As an important part of the Bitmart Ecosystem, Bitmart primarily serves as a global online platform for Digital Asset trading and provides Users with a trading platform, financing services, technical services, and other Digital Asset-related services. As further detailed in Article 3 below, Users must register and open an account with Bitmart and deposit Digital Assets into their account prior to trading. Users may, subject to the restrictions set forth in these Terms, apply for the withdrawal of Digital Assets.
Although Bitmart is committed to maintaining the accuracy of the information provided through Bitmart Services, Bitmart does not and cannot guarantee its accuracy, applicability, reliability, integrity, performance, or appropriateness, nor shall Bitmart be liable for any loss or damage that may be caused directly or indirectly your use of such content. The information about Bitmart Services may change without notice, and the primary purpose of providing such information is to help Users make independent decisions. Bitmart does not provide investment or consulting advice of any kind and is not responsible for the use or interpretation of information provided via Bitmart or any other communication medium. All Users of Bitmart Services must understand the risks involved in Digital Asset trading and are strongly encouraged to exercise prudence and trade responsibly within their financial means.
3. Bitmart Account Registration and Requirements
a. Registration
All Users must apply for a Bitmart Account at https://dashboard.bitmart.com/register before using Bitmart Services. When registering a Bitmart Account, you must provide the information identified in this Section 3 or as otherwise requested Bitmart, and accept these Terms, the Privacy Policy, and other Bitmart Platform Rules. Bitmart may, at its sole discretion, refuse to open a Bitmart Account for you. You agree to provide complete and accurate information when opening a Bitmart Account and agree to promptly update any information you provide to Bitmart in order to maintain its accuracy and integrity.
Each User (including natural persons, businesses, or legal entities) may maintain only one main account at any given time. However, Users may open one or more subaccounts under the main account with Bitmart’s consent. For certain Bitmart Services, you may be required to establish a specific account separate from your Bitmart Account, based on the provisions of these Terms or any Supplementary Terms. The registration, use, protection, and management of such trading accounts shall be equally governed the provisions of this Section and Section VI, unless otherwise stated in these Terms or the Supplementary Terms.
b. Eligibility
By registering to use a Bitmart Account, you represent and warrant that:
(i) as an individual, you are at least 18 years old or are of legal age to form a binding contract under applicable laws;
(ii) as an individual, legal person, or other organization, you have full legal capacity and sufficient authorizations to enter into these Terms;
(iii) you have not been previously suspended or removed from using the Bitmart Platform or the Bitmart Services;
(iv) you do not have an existing Bitmart Account;
(v) you are not a resident of, located in, or otherwise attempting to access the Bitmart Platform or the Bitmart Services from, or acting on behalf of a person or legal entity that is resident or located in, a Restricted Location. For the purposes hereof, “Restricted Location” shall include the United States, Malaysia, Ontario (Canada), and such other locations as designated Bitmart Operators from time to time;
(vi) if you are acting as an employee or agent of a legal entity and entering into these Terms on their behalf, you represent and warrant that you have all the necessary rights and authorizations to bind such legal entity and to access and use the Bitmart Platform and Bitmart Services on its behalf; and
(vii) your use of the Bitmart Platform and the Bitmart Services will not violate any applicable laws and regulations, including but not limited to those concerning anti-money laundering, anti-corruption, and counter-terrorist financing.
Please note that there are legal requirements in various countries that may restrict the products and services Bitmart Operators can lawfully provide. Accordingly, some products, services, and certain functionalities on the Bitmart Platform may not be available or may be restricted in certain jurisdictions or to specific users. You are solely responsible for informing yourself about and complying with any restrictions and/or requirements applicable to your access to and use of the Bitmart Platform and the Bitmart Services in any jurisdiction. Bitmart Operators reserve the right to change, modify, or impose additional restrictions at any time without prior notice.
c. User Identity Verification
Your registration for a Bitmart Account will be deemed your agreement to provide all required personal information for identity verification. This information will be used to verify your identity, detect money laundering, terrorist financing, fraud, and other financial crimes through Bitmart, or for other lawful purposes as stated Bitmart. We collect, use, and share this information in accordance with our Privacy Policy.
In addition, you agree to allow Bitmart to retain such information while your account is active and for five (5) years following its closure, in accordance with global data retention standards. You also authorize Bitmart to conduct necessary investigations—either directly or through a third party—to verify your identity or protect both you and Bitmart from financial crimes such as fraud.
The required verification information may include but is not limited to: your full name, email address, contact information, phone number, username, government-issued ID, date of birth, and other information collected during account registration. When providing this information, you confirm that it is true and accurate.
AFTER REGISTRATION, YOU MUST ENSURE THAT THIS INFORMATION IS TRUE, COMPLETE, AND TIMELY UPDATED WHEN CHANGED. IF ANY INFORMATION PROVIDED IS FOUND TO BE INCORRECT, FALSE, OUTDATED, OR INCOMPLETE, BITMART RESERVES THE RIGHT TO NOTIFY YOU TO CORRECT IT, DELETE THE RELEVANT INFORMATION, OR TERMINATE ALL OR PART OF THE BITMART SERVICES PROVIDED TO YOU.
If Bitmart cannot reach you through the contact information you provided, you will be fully liable for any loss or expense incurred Bitmart due to your use of the Services.
BY REGISTERING AN ACCOUNT, YOU HEREBY AUTHORIZE BITMART TO CONDUCT ANY INVESTIGATIONS IT CONSIDERS NECESSARY, DIRECTLY OR THROUGH A THIRD PARTY, TO VERIFY YOUR IDENTITY OR TO PROTECT YOU, OTHER USERS, AND/OR BITMART FROM FRAUD OR OTHER FINANCIAL CRIMES. YOU ALSO ACKNOWLEDGE AND AGREE THAT YOUR PERSONAL INFORMATION MAY BE DISCLOSED TO CREDIT BUREAUS AND AGENCIES FOR FRAUD PREVENTION OR FINANCIAL CRIME MONITORING PURPOSES.
d. Account Usage Requirements
The Bitmart Account may only be used the individual or entity for whom it was registered. Bitmart reserves the right to suspend, freeze, or cancel accounts being used individuals other than the registered account holder.
If you suspect or become aware of any unauthorized use of your username or password, you must notify Bitmart immediately. Bitmart assumes no liability for any loss or damage arising from the use of your account you or any third party, whether authorized or not.
e. Account Security
Bitmart is committed to safeguarding user assets and employs industry-standard protection mechanisms across its Services. However, your personal actions may still pose security risks. You agree to treat your account credentials (such as username and password) as confidential and not disclose them to any third party. You also agree to take full responsibility for safeguarding your Bitmart Account and any personal information.
You are solely responsible for keeping your credentials safe and for all activities under your account. Bitmart assumes no liability for losses resulting from authorized or unauthorized use of your account credentials, including but not limited to information disclosure, submission of online agreements, or acceptance of platform policies.
By registering a Bitmart Account, you agree to:

Notify Bitmart immediately upon becoming aware of any unauthorized use of your account or password, or any other breach of security rules;

Strictly adhere to all security, authentication, trading, fee, and withdrawal mechanisms or procedures established Bitmart;

Log out of your Bitmart Account at the end of each session.
III. Bitmart Services
Upon completing registration and identity verification, you may use a variety of Bitmart Services, including but not limited to:

Crypto-to-crypto trading
-
Fiat trading
-
Contract trading
-
Leveraged trading
-
Bitmart Savings
-
Staking
-
Access to market-related data and research
-
Participation in promotional or user activities hosted Bitmart
Use of these Services is subject to these Terms, the Bitmart Platform Rules, and any applicable supplementary agreements.
Bitmart reserves the right to:

Provide, modify, or discontinue any Bitmart Service at its sole discretion; and
-
Restrict or deny access to specific Services to certain Users in accordance with the Bitmart Platform Rules.
Bitmart has the exclusive authority to determine which Digital Assets are listed or delisted from the platform. Bitmart may also modify order sizes or trading pairs for any asset at any time, without prior notice. Bitmart shall not be held liable for any such listing, delisting, or adjustment, nor is it obligated to inform Users in advance of such changes.
Bitmart Service Usage Guidelines
1. License
Subject to your continuous compliance with the express terms and conditions set forth herein, Bitmart grants you a revocable, limited, royalty-free, non-exclusive, non-transferable, and non-sublicensable license to access and use Bitmart Services through your computer or Internet-compatible devices for your personal or internal purposes only. You are strictly prohibited from using Bitmart Services for resale or any commercial purposes, including conducting transactions on behalf of other individuals or entities. Any such acts constitute a material violation of these Terms.
The content layout, format, functionalities, and access rights of Bitmart Services are determined at Bitmart’s sole discretion. Bitmart reserves all rights not explicitly granted herein. Therefore, you may not use Bitmart Services in any manner not expressly authorized these Terms.
These Terms grant only a limited license to access and use Bitmart Services. You acknowledge that Bitmart does not transfer any ownership or intellectual property rights in Bitmart Services to you or any third party. All text, graphics, user interfaces, visual interfaces, photos, sounds, process flow diagrams, computer code (including HTML code), programs, software, products, information, and documents, as well as the design, structure, selection, coordination, expression, look and feel, and layout of any content included in or provided through Bitmart Services, are exclusively owned, controlled, or licensed Bitmart, its affiliates, licensors, or parent companies.
Bitmart retains ownership of any feedback, suggestions, ideas, or other materials (“Feedback”) you submit regarding Bitmart or Bitmart Services, whether through email, Bitmart Services, or other means. You heretransfer all rights, ownership, and interests in such Feedback to Bitmart, including all related intellectual property rights. You waive any rights to acknowledgment or compensation arising from your Feedback.
2. Restrictions
By using Bitmart Services, you agree to comply with the following restrictions:

Your activities must comply with all applicable laws, regulations, these Terms, and Bitmart’s guidelines;

Your use of Bitmart Services must not infringe upon public interests, morals, or the legitimate rights of others, including interfering with or disrupting other users’ access to Bitmart Services;
-
You agree not to use Bitmart Services for market manipulation (e.g., pump and dump schemes, wash trading, self-trading, front running, quote stuffing, spoofing, layering), regardless of whether such acts are prohibited law;
-
Without Bitmart’s prior written consent, the following commercial uses of Bitmart data are strictly prohibited:

Trading services using Bitmart quotes or market bulletin board information;
-
Data feeds or streaming services that use any Bitmart market data;
-
Websites, apps, or services that charge or profit (including advertising or referral fees) from Bitmart market data;
-
-
Without prior written consent from Bitmart, you may not modify, duplicate, copy, download, store, transmit, disseminate, transfer, disassemble, broadcast, publish, remove or alter copyright statements or labels, license, sublicense, sell, mirror, rent, lease, private label, grant security interests in, or create derivative works based on any part of Bitmart’s properties;

Accounts inactive for one month will be automatically deactivated Bitmart’s system. To reactivate, a valid deposit transaction is required. Failure to do so may result in account termination;

You may not use automated tools (e.g., bots, crawlers, spiders) or unauthorized means to access, obtain, copy, or monitor Bitmart Services or bypass its navigation structure;
-
Unauthorized attempts to access Bitmart’s servers or networks, probe or test vulnerabilities, violate security measures, track other users, disrupt normal operations, impersonate others, or use Bitmart Services illegally are strictly prohibited;
-
You may not make false allegations or defamatory claims against Bitmart. Such behavior may result in sanctions, including account termination.
By using Bitmart Services, you acknowledge and agree that Bitmart has the right to investigate any violations of these Terms and take actions at its sole discretion without prior notice or consent. Such actions may include, but are not limited to:
- Blocking and closing order requests;
- Freezing your account;
- Reporting the incident to the authorities;
- Publishing the alleged violations and actions that have been taken;
- Deleting any information you published that are found to be violations.
2. Crypto-to-Crypto Trading
Upon successful completion of registration and identity verification for your Bitmart Account, you may engage in Crypto-to-Crypto Trading on Bitmart in accordance with these Terms and the Bitmart Platform Rules.
a. Orders
When you submit an instruction to use Bitmart Services for Crypto-to-Crypto Trading (an “Order”), your account will be immediately updated to reflect any open Orders. Your Orders will be included in Bitmart’s order book and matched against other users’ Orders. If your Order fully or partially matches another user’s Order, Bitmart will execute a trade (a “Transaction”). Once a Transaction is executed, your account will be updated to show the Order as fully executed and closed, or partially executed with the remaining portion open. Orders remain open until fully executed or cancelled as per paragraph (b) below.
By placing an Order, you authorize Bitmart to temporarily control the digital assets involved in the Transaction to complete the trade.
b. Cancellation
You may cancel an Order only before it has been matched with another user’s Order. Once an Order is matched, it cannot be changed, revoked, or cancelled. For partially matched Orders, you may cancel the unmatched portion unless it has been matched. Bitmart reserves the right to reject any cancellation requests.
If your account does not hold sufficient digital assets to fulfill an Order, Bitmart may cancel the entire Order or partially execute it based on the available assets in your account. Transaction fees, as detailed in paragraph (c), will be deducted accordingly.
c. Fees
You agree to pay Bitmart the applicable fees for Transactions as specified on the Bitmart fee schedule. Bitmart may update fees at any time, with new fees applying to all Transactions executed after the update’s effective date. You authorize Bitmart to automatically deduct any fees owed from your account.
d. Other Types of Crypto-to-Crypto Trading
Beyond the basic order placement described above, Bitmart may offer additional Crypto-to-Crypto Trading features under separate Bitmart Platform Rules, such as One Cancels the Other (OCO) orders, block trades, and other advanced order types, at its sole discretion.
3. Fiat Trading
Prior to conducting Fiat Trading, you shall separately read, agree to, and comply with:
a. the Terms of Use of Bifinity UAB;
b. The User Agreements with various third-party service providers with whom Bitmart has partnered to offer Fiat Trading services, and, if applicable, you may need to open an account with such partners following the completion of registration and identity verification for your Bitmart Account;
c. The Legal Statement, the Privacy Policy, and any other Bitmart Platform Rules related to Fiat Trading.
If you choose to utilize Fiat Trading, you acknowledge that Bitmart collaborates with regulated third-party service providers to offer such services. These providers operate under the laws and regulations of their respective jurisdictions. A full list of Bitmart’s fiat service partners can be found [here] (insert link).
Please note that Bitmart is not a licensed financial services provider for fiat currency transactions. Fiat payment and exchange services are provided Bitmart’s partners and may be subject to their respective regulatory oversight, but are not regulated Bitmart.
4. Futures Trading
Unless otherwise specified Bitmart, to conduct Futures Trading, you must enter into a separate Bitmart Futures Service Agreement and open a dedicated Collateral Account, following the completion of registration and identity verification for your Bitmart Account. You acknowledge and agree that:
a. You fully understand the high risks associated with Futures Trading, including but not limited to the risks of significant fluctuations in Digital Assets prices and the potential for amplified losses when leverage is used;
b. You possess sufficient investment knowledge, experience, and risk tolerance to engage in Futures Trading, and you agree to independently bear all risks arising from Futures Trading investments;
c. Prior to engaging in Futures Trading, you have read, understood, and agreed to all terms outlined in the Bitmart Futures Service Agreement and the relevant Bitmart Platform Rules, and have consulted with appropriate professionals to make informed decisions regarding your participation in Futures Trading based on their recommendations and your own judgment;
d. You agree and authorize Bitmart to take various reasonable measures in its discretion (including but not limited to forced liquidation and forced position reduction under specific circumstances) in accordance with the Bitmart Futures Service Agreement and the relevant Bitmart Platform Rules to protect the legitimate interests of you, Bitmart, and other Users.
5. Options Trading
Before entering into transactions in Options products through Bitmart (“Options Trading”), you acknowledge and agree that:
a. You fully understand the high risks associated with Options Trading, including but not limited to the risk of significant fluctuations of Digital Assets in Options Trading and the risk of exacerbated adverse outcomes when leverage is used;
b. You have sufficient investment knowledge, experience, and the capacity to assume risks arising from Options Trading, and agree to independently bear all risks arising from Options Trading investments;
c. Prior to engaging in Options Trading, you have read, understood, and agree to be bound the terms of the Bitmart Options Service Agreement and all relevant Bitmart Platform Rules, which supplement these Terms of Use, and you have consulted relevant professionals to make informed decisions on whether and how to conduct Options Trading based on their advice and your own judgment;
d. You agree and authorize Bitmart to take various reasonable measures in its discretion (including but not limited to forced liquidation and forced position reduction under specific circumstances) in accordance with the Bitmart Options Service Agreement and relevant Bitmart Platform Rules to protect the legitimate interests of you, Bitmart, and other Users.
6. Margin Trading
By using the Margin Services, you acknowledge and agree that you have read, understood, and accepted the “Margin Service Terms of Use,” which apply to all Margin Services (as defined therein).
7. Lending Services
Unless otherwise specified Bitmart, to borrow currencies through Lending Services, you must enter into a separate Lending Services User Agreement with Bitmart and open a dedicated Collateral Account and/or complete other required procedures following the registration and identity verification for your Bitmart Account. You understand and agree that:
a. Lending Services involve significant risks, including but not limited to risks related to fluctuations in the value of borrowed Digital Assets, derivative risks, and technical risks. You shall carefully evaluate your financial situation and these risks before deciding to use Lending Services and accept full responsibility for any losses incurred;
b. You shall cooperate with Bitmart in providing all necessary information and materials related to identity verification and Lending Services and are solely responsible for maintaining the security of your Collateral Account and personal information;
c. You shall carefully review relevant Bitmart Platform Rules before using Lending Services, be aware of, understand, and comply with the specific information and rules regarding Lending Services operations, and ensure the use of borrowed assets complies with these Terms and applicable laws and regulations;
d. Bitmart reserves the right to manage your Collateral Account and collateral during the Lending Services period and to implement risk control measures, including but not limited to forced liquidation, as set forth in the Lending Services User Agreement or these Terms. You acknowledge such measures may result in significant losses for which you will be solely responsible;
e. Bitmart may temporarily or permanently restrict your use of Lending Services when deemed necessary or reasonable and, to the fullest extent permitted law, shall not be liable for any such actions.
8. Bitmart Savings Service
Bitmart offers Bitmart Savings, a value-added service for Users’ idle Digital Assets. To use Bitmart Savings, you must enter into a separate Bitmart Savings Service User Agreement and open a dedicated Bitmart Savings account following the completion of registration and identity verification for your Bitmart Account. a. Assets in Bitmart Savings may be used in cryptocurrency leveraged borrowing and other related businesses;
b. By using Bitmart Savings, you unconditionally authorize Bitmart to distribute and allocate leveraged interest according to Bitmart Platform Rules;
c. You shall comply with applicable laws and regulations ensuring that the sources of Digital Assets are legitimate and compliant when using Bitmart Savings;
d. You acknowledge and accept the inherent risks of investing in Digital Assets and agree to exercise caution when using Bitmart Savings;
e. All investment activities conducted on Bitmart represent your true investment intentions, and you unconditionally accept the potential risks and benefits associated with your investment decisions;
f. Bitmart reserves the right to suspend or terminate the Bitmart Savings service at any time;
g. Due to factors such as network delays, system failures, and other force majeure events, the execution of Bitmart Savings services may be delayed, suspended, terminated, or deviate from expectations. Bitmart will use reasonable efforts to maintain stable and effective operation but does not guarantee performance and shall not be liable for any resulting discrepancies.
9. Staking Programs
Bitmart may, from time to time, launch Staking Programs for specific types of Digital Assets to reward users who hold such assets in their Bitmart Accounts, in accordance with certain rules. By participating in Bitmart Staking Programs, you acknowledge and agree to the following:
a. Unless otherwise stated Bitmart, Staking Programs are offered free of charge, and Users may continue to trade the staked Digital Assets during the staking period;
b. Bitmart does not guarantee Users’ proceeds under any Staking Program;
c. Bitmart has the right to initiate or terminate Staking Program for any Digital Currencies or modify rules on such programs in its sole discretion;
d. Users shall ensure that sources of the Digital Currencies they hold in Bitmart Accounts are legal and compliant and undertake to observe related laws and regulations. Otherwise, Bitmart has the right to take necessary steps in accordance with these Terms or Bitmart Platform Rules, including, without limitation, freezing Bitmart Accounts or deducting the Digital Currencies awarded to Users who violate the rules of respective Staking Programs.
10. Bitmart POS Service Agreement
a. Bitmart has launched the Bitmart POS service to allow users to earn rewards from idle cryptocurrency assets held in their Bitmart accounts.
b. Assets enrolled in Bitmart POS may be utilized in staking protocols and other yield-generating blockchain-related services to generate rewards.
c. By participating in the Bitmart POS service, you unconditionally authorize Bitmart to distribute staking rewards in accordance with the applicable platform rules.
d. You agree to comply with all relevant laws and regulations in your jurisdiction, and confirm that all digital assets used in the Bitmart POS service originate from lawful and compliant sources.
e. You acknowledge the inherent risks associated with investing in cryptocurrencies and using staking services, and you agree to act prudently and at your own risk.
f. You confirm that all investment activities conducted via Bitmart represent your genuine investment intent, and you fully accept the associated risks and potential benefits.
g. Bitmart reserves the right to suspend or terminate the POS service at its sole discretion and may do so at any time, with or without notice.
h. Bitmart will use commercially reasonable efforts to ensure the stable operation of the POS service. However, you understand that network delays, system failures, or other force majeure events may result in delays, interruptions, or inconsistencies in service execution. Bitmart shall not be held liable for any such issues or any resulting differences between expected and actual outcomes.
11. Bitmart Convert Services
a. Upon successful completion of registration and identity verification for your Bitmart Account, you may gain access to the Bitmart Convert Services, which enable users to buy and sell Digital Assets at prices provided Bitmart. Through the Bitmart Convert Services, users may submit a request to convert one type of Digital Asset into another (a “Conversion”), which Bitmart may, at its sole discretion, choose to accept or reject. If the request is accepted, a Digital Asset spot transaction will be executed between Bitmart and the user, subject to the terms outlined in this Clause.
b. To initiate a Conversion between supported trading pairs on the Platform, users may place:
(i) a Convert Market Order, which specifies the type and quantity of the Digital Asset to be converted, and the type of Digital Asset to be received; and/or
(ii) a Convert Limit Order, which specifies the type and quantity of the Digital Asset to be converted, the type of Digital Asset to be received, the limit price at which the Conversion is to occur, and the expiration date of the order.
For the purposes of the Bitmart Convert Services, references to the “Platform” shall include any website, feature, content, or interface operated Bitmart, any official Bitmart mobile application, or any Bitmart API Connection provided to users or third-party services that rely on such integration, or any other access method Bitmart may designate from time to time.
If a User submits a Convert Market Order, Bitmart may (but is not required to) provide a non-binding, indicative, and discretionary quote for the conversion (a “Convert Quote”). This quote may be accepted or declined the User within the timeframe specified solely Bitmart. It is the User’s responsibility to assess the competitiveness of the quoted price and decide whether to accept the Convert Quote within the valid period.
Acceptance of a Convert Quote results in a trade request being submitted to Bitmart (a “User Trade Request”). Upon submission of a User Trade Request, you authorize Bitmart to temporarily lock the Digital Assets intended for conversion — pending completion of the Transaction — subject to Bitmart’s rights to reject the request under the terms set forth below.
d. Discretionary Execution
Even after the User submits a Trade Request, Bitmart is not obligated to execute the conversion. At its sole discretion — considering prevailing market conditions and other factors — Bitmart may accept or reject the User Trade Request.
e. Settlement Process
If Bitmart accepts your Trade Request, the quoted price and specified asset amounts are guaranteed, regardless of any price fluctuation since the quote was issued. Bitmart will settle the Conversion debiting your Bitmart Account for the agreed amount and crediting it with the corresponding Digital Assets. Settlement typically completes within approximately 10 seconds from Bitmart’s acceptance, though Bitmart does not guarantee this timeframe — it may take longer due to market conditions, technical issues, or other factors.
Once a User Trade Request is accepted Bitmart, it cannot be cancelled. You may not transfer, withdraw, or trade the assets involved until the transaction is finalized. Bitmart is not liable for any loss of opportunity or adverse price movement during this settlement period.
f. Convert Limit Orders
Bitmart may, at its sole discretion, accept or reject any Convert Limit Order. Even if the market price meets or exceeds the limit price set the User, Bitmart does not guarantee execution of the Limit Order due to variable market conditions and liquidity constraints. Bitmart is not liable for any opportunity cost or loss resulting from the non-execution of a Convert Limit Order. If a Limit Order is executed, the same settlement mechanisms described in subsection (e) apply.
g. Asset Listing & Conversion Eligibility
Bitmart retains exclusive authority to determine which Digital Assets and asset pairs are available for conversion. Bitmart may add or remove assets or trading pairs and modify permissible order sizes at any time without prior notice or user liability. Bitmart may, but is not obligated to, notify users about such changes.
h. User Responsibility & Risk Acknowledgment
Users are strongly encouraged to perform independent research on Digital Assets before using Convert Services. You accept full responsibility for determining if Bitmart Convert Services align with your financial objectives and circumstances. You alone bear all outcomes — gains or losses — resulting from your use of Bitmart Convert Services. Bitmart makes no representations or guarantees regarding investment outcomes via its Convert Services or otherwise.

Bitmart currently does not support Convert Limit Orders via any Bitmart API Connection. API access is strictly limited to Convert Market Order submissions.

Bitmart may, at its sole discretion and at any time, change API endpoints or adjust settings—including trading limits or minimum order amounts—for specific users, without any obligation to provide prior notice.

Bitmart may restrict or terminate an API Connection at any time for any reason, such as suspected price arbitrage, market manipulation, or exploitation of pricing data. No prior notice or explanation is required.

API Connections are provided “as is”, entirely at your own risk. Bitmart is not liable for errors, malfunctions, downtime, or any loss incurred you or third parties due to the use, or inability to use, the API.

If you redistribute pricing obtained via a Bitmart API Connection—whether for Convert Services or otherwise—Bitmart is not a party to such transactions. You are solely responsible for your transactions and relationships with third parties, including compliance with all applicable laws.

Should you mark up or apply a spread to Bitmart-provided prices when trading with your customers, you are fully responsible for determining such adjustments. Bitmart disclaims any involvement or liability in these decisions.

Unless explicitly authorized in writing Bitmart, you may not identify Bitmart as the price source to third parties, use the “Bitmart” name, or display Bitmart logos or trademarks in your marketing or communications.
12. Bitmart Leveraged Tokens
Before trading Bitmart Leveraged Tokens, you acknowledge that you have read, understood, and accepted the Bitmart Leveraged Tokens Risk Disclosure Statement and the Bitmart Leveraged Tokens Agreement. These documents govern all subscriptions, redemptions, and transactions involving Bitmart Leveraged Tokens.
13. BUSD Conversion
A. Deposits
From the Conversion Inception Date determined Bitmart, any deposit or receipt of a Designated Stablecoin into your Bitmart Account will be automatically converted into an equivalent amount of BUSD at a 1:1 ratio.
B. Existing Balances
On the Conversion Inception Date, any balance denominated in a Designated Stablecoin held in your Bitmart Account will also be converted into BUSD on a 1:1 basis.

C. Withdrawals
On or after the Conversion Inception Date, if you maintain a balance in your Bitmart Account denominated in BUSD, you may submit instructions to withdraw such balance either in BUSD or in one of the Designated Stablecoins.
If you opt to withdraw in a Designated Stablecoin, you will receive an equivalent amount converted from BUSD at a 1:1 ratio, minus any applicable withdrawal and transaction fees.
D. Exceptions
Bitmart reserves the right to suspend or terminate the Stablecoin Conversion functionality for any or all Designated Stablecoins at any time and without prior notice.
Where necessary due to market volatility or other factors affecting one or more Designated Stablecoins, Bitmart may adjust the applicable conversion rate at its sole discretion.
14. Bitmart OTC Services
If separately agreed with Bitmart, you may be granted access to certain Over-the-Counter (OTC) services for bilateral Digital Asset transactions.
Such services are governed the Bitmart OTC Terms, and you agree to be bound those terms with respect to all OTC Services conducted through Agreed Communication Channels, as defined in the Bitmart OTC Terms.
IV. Liabilities
1. Disclaimer of Warranties
To the fullest extent permitted applicable law, the Bitmart Services, Bitmart Materials, and any other product, service, or item provided or on behalf of Bitmart are offered “as is” and “as available”, without any warranty, express or implied.
Bitmart disclaims all implied warranties, including but not limited to:
-
merchantability,
-
fitness for a particular purpose,
-
title and non-infringement,
-
and warranties arising from usage in trade, performance, or course of dealing.
Bitmart does not guarantee:
-
the accuracy, reliability, completeness, or timeliness of the platform,
-
that any order will be executed, accepted, or remain open,
-
or that the platform will be free of errors, viruses, or harmful components.
You acknowledge that you have not relied on any other statements or agreements, whether oral or written, not expressly set forth in these Terms.
Bitmart shall not be liable for losses or damages arising from:
-
(a) inaccuracies or omissions in Digital Asset pricing data;
-
(b) transmission errors or delays;
-
(c) service interruptions;
-
(d) scheduled or unscheduled maintenance;
-
(e) third-party misconduct or violations of the Terms;
-
(f) illegal activities third parties; or
-
(g) any other disclaimers noted in Bitmart’s Platform Rules or official notices.
Note: These disclaimers may not apply in jurisdictions where exclusions of implied warranties are prohibited law.
2. Limitation of Liability
To the maximum extent permitted under applicable law, in no event shall Bitmart, its affiliates, or any of their respective shareholders, directors, officers, employees, agents, contractors, or licensors be liable for:

incidental, indirect, special, punitive, or consequential damages;
-
including but not limited to loss of data, revenue, profits, or other economic advantage;
-
arising out of or related to the use of Bitmart Services, regardless of the theory of liability—even if Bitmart has been advised of the possibility of such damages.
Except where there is a final judicial determination that damages were caused Bitmart’s gross negligence, fraud, willful misconduct, or intentional violation of law.
If your jurisdiction does not allow certain exclusions or limitations of liability, parts of this section may not apply.
Maximum Liability: Notwithstanding anything to the contrary, Bitmart’s total liability for any claim related to these Terms shall not exceed the amount of fees you paid to Bitmart in the twelve (12) months preceding the event giving rise to the claim.
3. Indemnification
You agree to indemnify, defend, and hold harmless Bitmart, its affiliates, licensors, service providers, and their respective officers, directors, employees, and agents from any and all:

claims,

demands,
-
investigations,
-
legal actions,
-
losses,
-
liabilities,
-
costs or expenses (including attorneys’ fees),
arising out of or related to:

(i) your use of or conduct in connection with the Bitmart Services;

(ii) your violation of these Terms or any applicable law;

(iii) your infringement of the rights of any third party.
Bitmart reserves the right, at its sole discretion, to control any action or proceeding subject to indemnification, and to determine whether and how to settle any claim.

Please note that all official announcements, news, promotions, competitions, and airdrops will be published at:

Users are solely responsible for regularly checking and reviewing these materials.
Bitmart shall not be held liable for any losses incurred due to users’ ignorance, negligence, or failure to act upon official communications posted via the above channel.
VI. Termination of Agreement
1. Suspension of Bitmart Accounts
You agree that Bitmart has the right to immediately suspend your Bitmart Account (and any associated accounts owned related entities or affiliates), freeze or lock the Digital Assets or funds therein, and restrict your access to Bitmart Services for any reason, including if:

You are suspected of violating these Terms, the Privacy Policy, or applicable laws and regulations;
-
There is a government or regulatory investigation, legal proceeding, or other enforcement action involving your account;
-
Suspicious or unauthorized activity is detected;
-
You engage in false public allegations that damage Bitmart’s reputation;
-
Required a court order, subpoena, or governmental request.
Bitmart is not liable for any temporary or permanent modification, suspension, or termination of your access.
Bitmart reserves the right to retain transaction data or other relevant information pertaining to the suspended account.
2. Cancellation of Bitmart Accounts
Bitmart reserves the right to terminate your account and this Agreement, and to permanently revoke access to Bitmart Services in any of the following cases:

Bitmart ceases providing services to you;
-
You register a new account after prior termination, either directly or via a proxy;
-
Information you provided is false, incomplete, outdated, or misleading;
-
You reject updated Terms of Use;
-
You request termination of your Bitmart account;
-
Any other situation where Bitmart determines termination is necessary.
If your account is terminated, account and transaction data required law will be securely retained for 5 years.
If a transaction is pending during termination, Bitmart reserves the right to notify the counterparty.
Note: If you initiate account closure under data protection laws (e.g., GDPR), this termination protocol still applies.
If Bitmart receives credible information that any assets in your account were stolen or unlawfully obtained, Bitmart may place an administrative hold on those funds.
Such a hold may remain until the dispute is resolved, with acceptable documentation provided.
Bitmart will not act as a mediator in such disputes and disclaims any liability for delays or loss of access to funds during this period.
3. Remaining Funds After Account Termination
Once your Bitmart Account is closed or withdrawn, any remaining account balance (including fees owed) becomes immediately due.
After settling all outstanding fees, you will have five (5) business days to withdraw all Digital Assets and/or funds.
4. Termination Due to Fraud or Violation of Law
If your account is terminated due to fraud, legal violations, or breach of these Terms:

Bitmart will retain full custody of your Digital Assets and funds;
-
All relevant data may be turned over to government or regulatory authorities as required;
-
You may lose access to any or all account assets without compensation.
5. Dormant Accounts
Bitmart reserves the right to classify your account as dormant and take appropriate action if:
-
You fail to withdraw assets or close open positions within 30 days of receiving written notice.
Bitmart may then, without prior notice:
(a) Designate your account as dormant;
(b) Close open positions;
(c) Convert assets to another Digital Asset (e.g., BTC to USDT), with no liability for resulting losses or tax consequences;
(d) Transfer assets to an affiliate, third-party custodian, or isolated wallet, subject to KYC requirements for retrieval;
(e) Apply a monthly dormant account fee to cover custody costs;
(f) Permanently close the dormant account.
Once closed, dormant accounts cannot be reactivated. If you wish to resume using Bitmart, you must register a new account

VII. No Financial Advice
Bitmart is not your broker, intermediary, agent, or advisor, and does not owe you any fiduciary duty in connection with any transactions, activities, or decisions you undertake using Bitmart services. No communication or information provided Bitmart should be considered as investment advice, financial advice, trading advice, or any form of recommendation.
Unless explicitly stated in these Terms, all trades are executed automatically based solely on your instructions and predefined parameters. You are solely responsible for evaluating whether any digital asset, trading strategy, or investment decision is appropriate based on your personal financial circumstances, risk profile, and investment objectives.
You should seek independent legal, financial, or tax advice before making any investment decisions. Bitmart does not endorse or recommend the purchase, sale, or holding of any particular Digital Asset.
Bitmart shall not be held liable for any decisions you make to buy, sell, or hold any Digital Asset based on information obtained through Bitmart.
VIII. Compliance with Local Laws
Users are solely responsible for understanding and complying with all applicable local laws and regulations regarding the use of Bitmart Services, including but not limited to tax reporting, remittance, and legal use of digital assets.
All users of Bitmart Services affirm that their funds are sourced from legitimate activities and do not originate from any unlawful conduct. Bitmart may, at any time and at its sole discretion, request information to verify the source and legality of funds in compliance with applicable regulations and governmental orders.
Bitmart maintains a strict cooperative stance with law enforcement and reserves the right to seize, freeze, suspend, or terminate accounts and assets if flagged or investigated legal authorities.
IX. Privacy Policy
Your use of Bitmart Services may require the submission of personally identifiable information. Please refer to Bitmart’s Privacy Policy for details on how we collect, store, and use your data.
X. Dispute Resolution, Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR ABILITY TO BRING LEGAL CLAIMS IN COURT OR AS A CLASS ACTION.
1. Informal Dispute Resolution
If you have a dispute with Bitmart, we encourage you to first contact us via our support center to resolve the issue informally. Upon contacting Bitmart, a support ticket will be issued and efforts will be made in good faith to resolve the dispute confidentially and without legal proceedings.
If a resolution is not achieved, you must submit a formal Notice of Claim before initiating arbitration. The Notice must include:

A description of the issue and basis of your claim

The specific relief sought

Your Bitmart account email

The original support ticket number
This is a prerequisite to any arbitration or legal claim.
2. Arbitration Agreement and Governing Law
If disputes remain unresolved, you agree to resolve them through binding, individual arbitration in accordance with the HKIAC Administered Arbitration Rules in effect at the time. This arbitration shall be conducted in English, seated in Hong Kong, and administered the Hong Kong International Arbitration Centre (HKIAC).
The arbitrator shall have exclusive authority to resolve disputes, including questions related to:

The scope or enforceability of this arbitration agreement

The existence of this agreement

Jurisdiction of the arbitrator
There shall be no right to bring disputes as class, collective, representative, or private attorney general actions. Only individual arbitration is permitted.
Any legal claim must be initiated within one (1) year from when the user knew (or reasonably should have known) of the event giving rise to the dispute.
Confidentiality: All arbitration proceedings and related materials shall remain confidential, except where disclosure is legally required.
3. Class Action Waiver
By using Bitmart Services, you agree that all disputes must be brought individually. You waive any right to:

Act as a class representative or class member

Bring or participate in any collective, representative, or class action arbitration or proceeding
Combining or consolidating claims without written consent of all parties, including Bitmart, is not permitted.
4. Modifications to Arbitration Terms
Bitmart reserves the right to modify this arbitration agreement as permitted law. Continued use of your Bitmart account following any such changes shall constitute your acceptance.
If you do not agree to any modifications, Bitmart may suspend your account until closure is complete. Previous arbitration terms will govern until closure is finalized.
5. Severability
If any part of this arbitration agreement is found to be unenforceable, the remainder shall remain in full force and effect.
XI. Miscellaneous Provisions
1. Independent Relationship
You and Bitmart are independent entities, and nothing in these Terms shall be construed as creating a partnership, joint venture, or agency relationship.
2. Entire Agreement
These Terms constitute the entire agreement between you and Bitmart, superseding any prior oral or written agreements.
3. Updates and Revisions
Bitmart reserves the right to modify these Terms at any time. All updates will take effect immediately upon being posted. You are responsible for reviewing the Terms regularly.
Continued use of Bitmart Services indicates acceptance of any updated Terms. If you do not agree with the modifications, you must discontinue use and close your account.
4. Language & Translations
If these Terms are provided in multiple languages, the English version shall prevail in the event of any conflict or discrepancy.
5. Force Majeure
Bitmart is not liable for delays or failures to perform due to events beyond its reasonable control, including but not limited to acts of God, internet outages, government actions, or natural disasters.
6. Severability
If any portion of these Terms is deemed invalid, the remaining provisions shall remain fully enforceable.
7. Assignment
You may not assign your rights or obligations under these Terms without Bitmart’s prior written consent. Bitmart may assign its rights or obligations at any time without notice or your approval.
8. Waiver. The failure of one party to require performance of any provision will not affect that party’s right to require performance at any time thereafter. At the same time, the waiver of one party to seek recovery for the other party’s violation of these Terms or any provision of applicable terms shall not constitute a waiver that party of any subsequent breach or violation the other party or of the provision itself.
Any links to third-party websites accessible through BitMart Services do not imply any endorsement BitMart of the products, services, information, or disclaimers presented on such sites. BitMart does not guarantee the accuracy or completeness of information found on third-party websites. If you incur any losses or damages from using products or services offered third-party sites, BitMart shall not be liable. Furthermore, as BitMart does not control the terms of use or privacy policies of third-party websites, you are strongly encouraged to review and understand those terms before engaging with them.
10. Matters Related to Apple Inc.
If you use any Apple Inc. device to access BitMart Services or participate in any commercial activities, reward programs, or other offerings provided BitMart, you acknowledge that such activities are solely offered BitMart and are in no way associated with, endorsed by, or affiliated with Apple Inc.
